Terms of Service

Effective Date: May 22 2025

The Delfhos service is provided by David Serrano Díaz (DNI/NIF: 03226056F), acting as a sole proprietor under the trade name "Delfhos".

Welcome to Delfhos. By accessing or using our software-as-a-service platform (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Accounts, Balance & Usage
   • Account Types: You may open a Business or an Individual account. All consumption is deducted from your prepaid balance.
   • Pricing Model: Usage is charged per request against your account balance. You may top up at any time.
   • Refunds: Spent balance is non-refundable. Unused balance may be refunded on request, subject to any applicable terms or fees.
2. Module Access & Integrations
   • Supported Modules: Today, Delfhos connects to SQL databases; future releases will include additional apps and APIs.
   • Credential Handling: To access your data sources, you must provide connection credentials. These credentials:
     • Are encrypted end-to-end at runtime
     • Are never stored in any retrievable form
     • Cannot be decrypted or accessed by Delfhos or any third party
3. Data Privacy & Retention
   • No Conversation Logging: User queries, model responses, and session transcripts are not stored. We do not retain any information exchanged between you and the AI.
   • Result Storage: We do not persist the content of any result set beyond the individual session.
   • Security: All in-flight data (credentials, queries, responses) is handled in memory only, with industry-standard encryption.
4. Prohibited Conduct

   You agree not to use the Service to:

   • Violate any applicable laws or regulations
   • Attempt to reverse-engineer, tamper with, or bypass our security controls
   • Send unsolicited or bulk communications through the platform
5. Intellectual Property
   • Service IP: All software, documentation, trademarks, and other technology provided by Delfhos remain the sole property of Delfhos or its licensors.
   • Your Data: You retain ownership of your data and any outputs produced from it.
6. Termination & Suspension
   • We may suspend or terminate your access immediately upon breach of these Terms or for any lawful reason.
   • Upon termination, your unused balance remains refundable as per Section 1.
7. Disclaimers & Limitation of Liability
   • AS-IS: The Service is provided "as-is" without warranty of any kind.
   • Liability Cap: Delfhos's total aggregate liability under these Terms shall not exceed the amount you have paid in the prior six months.

   As the Service is operated by an individual sole proprietor, you expressly acknowledge that any liability is limited to the personal capacity of the provider, and subject to the cap stated below.

8. Data Processing Agreement (DPA)

   Where applicable under applicable data protection laws (e.g., GDPR), you and Delfhos agree to the terms of our Data Processing Agreement, which governs the processing of personal data on your behalf when using the Service. This DPA forms an integral part of these Terms.

9. Governing Law and Jurisdiction

   These Terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain.

10. Changes to These Terms

    We may update these Terms at any time. We will notify you of material changes via email or in-app notice. Continued use after notice constitutes acceptance.
